A Preliminary Asset Search, which is designed to locate and identify company or individual assets, such as real and/or personal property, vehicles, watercraft or aircraft.

A Comprehensive Asset Search designed to document an identified asset; this search includes detailed photographs, witness statements and copies of foreign ownership documents if available.

Note: SEARCHES needs the name, address, social security number and date of birth at minimum. Also desirable are names of family members, names of current and prior companies and geographical locations where the subject has lived, as well as any background information in your files.

What does a financial institution do when their contract goes into default, and their collateral literally sails or drives away? It is true that most financial institutions don't make loans on personal property located outside their respective countries. However, Mexico is exactly where many go when they are avoiding foreclosure or repossession.

There are three types of recoveries:

VOLUNTARY REPOSSESSION

INVOLUNTARY REPOSSESSION

STOLEN & RECOVERY

VOLUNTARY REPOSSESSION implies the voluntary compliance of the debtor who is in possession of the property, who gives the actual location of the property, and who may or may not be present at the moment of the repossession. The key criteria here is that the occupant does not in any manner display any form of objection or inhibit the repossession, which could be legally construed as a breach of peace.

Mexico will not allow repossession in a breach of peace situation and our field agent could very well land in jail under such circumstances. In such a case, we must desist all activity, and proceed as outlined under Involuntary Repossessions.

In a voluntary repossession, there are generally no statutes prohibiting the process, as it is a question of mutual consent, and a formal foreclosure act is generally not required to affect the repossession. At this point, we make a detailed inspection report, complete with photographs. Once in our hands and in a safe port, we can hand over said property to the rightful owner's) or deliver that property to the U.S. border or a designated U.S. location.

An INVOLUNTARY REPOSSESSION is where the occupant does not give his/her express consent. In some countries, commercial law allows a financing body to repossess an asset that was financed as collateral. In the event the contractual conditions of the mortgage are not met, the financing body (or legal owner) may repossess the property, without formal foreclosure procedures PROVIDING that there is no breach of the peace. The key criteria here is that the occupant does not in any manner display any form of objection to or inhibit the repossession act which could be legally construed as or give rise to a breach of the peace situation.

STOLEN & RECOVERY

Stolen and recovery are handled as an Involuntary repossession. If the person's) in physical possession refuses to give up the property, it becomes a police matter. The local authorizes will be notified and the person may be taken into custody. The recovery of that property will then be handled under the treaty between Mexico and the United States.
